the exclusive jurisdiction and venue of the courts located therein. Notwithstanding the foregoing, either party may apply to any
court of competent jurisdiction for injunctive relief. Except as otherwise specified, these Terms of Use and our Privacy Policy Statement,
constitute the entire understanding between you and GEOTrac with respect to the GEOTrac Website and supersedes all prior understanding
between you and GEOTrac with respect to the GEOTrac website.
Toggle Switch Use Policy
Re: CAUTION AGAINST USING A TOGGLE SWITCH TO TERMINATE POWER TO GEOTRAC WORK ALONE SERVICES
BY USING A TOGGLE SWITCH AND THE WIRELESS TELECOMMUNICATION SERVICE ON WHICH IT OPERATES, YOU AGREE TO ACCEPT THE TERMS AND CONDITIONS
SET OUT BELOW.
THIS TOGGLE SWITCH AND THE WIRELESS TELECOMMUNICATION SERVICE ON WHICH IT OPERATES MAY CONTAIN TECHNOLOGY THAT IS NOT FAULT TOLERANT
AND IS NOT DESIGNED, MANUFACTURED, OR INTENDED FOR USE IN ENVIRONMENTS OR APPLICATIONS IN WHICH THE FAILURE OF THE SOFTWARE PRODUCTS
COULD LEAD TO DEATH, PERSONAL INJURY, OR SEVERE PHYSICAL, PROPERTY OR ENVIRONMENTAL DAMAGE. YOU, THE CUSTOMER, AGREE THAT BY PROVIDING
A TOGGLE SWITCH TO TERMINATE THE POWER TO THE GEOTRAC SERVICE MANUALLY, THAT THERE IS A HIGH RISK THAT THE GEOTRAC SERVICE MAY BE TURNED
OFF OR KEPT OFF BY THE USER THAT WILL RESULT IN THE SERVICE NOT WORKING DURING WORK ALONE OR CRITICAL OPERATION PERIODS. AT THE REQUEST
OF THE CUSTOMER, THIRD PARTY INSTALLATION CONTRACTORS HAVE BEEN ASKED TO INSTALL THESE TOGGLE SWITCHES. THIS SHOULD, IN NO WAY, BE
CONSTRUED AS GEOTRAC OR THE INSTALLATION CONTRACTORS SUPPORTING OR RECOMMENDING THIS APPROACH TO MANUALLY TURN OFF GEOTRAC SERVICES
USING A TOGGLE SWITCH.
YOUR USE OF A TOGGLE SWITCH TO TURN OFF THE WIRELESS TELECOMMUNICATION SERVICE IS AT YOUR SOLE RISK. YOU ARE SOLELY RESPONSIBLE FOR
MONITORING AND RESPONDING TO MESSAGES THAT THIS PRODUCT GENERATES.
GEOTRAC WILL NOT BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY DAMAGES (DIRECT, INDIRECT, CONSEQUENTIAL OR OTHER, INCLUDING PHYSICAL I
NJURY, DEATH OR DAMAGE TO YOUR PROPERTY OR PREMISES), EXPENSES, LOSS OF PROFITS, LOSS OF EARNINGS, LOSS OF BUSINESS OPPORTUNITIES,
LOSS OF DATA, OR OTHER SIMILAR LOSS, ARISING OUT OF OR IN CONNECTION WITH THE PROVISION, USE OR FAILURE OF THE PRODUCT.
